America, and all oversea countries, including Australia, will be despatched from time to time by the beßt route without special notification. APPEAL AGAINST MAGISTRATE'S DECrSIOK, In the Supreme Court on Wednesday before His Honor, Mr Justice Edwardß, an appeal was heard on behalf of Charles Bowden (Mr. lE. H- Billing) against a decision of Mr. A Crooke, fi.M-, at New Plymouth. Mr. A. 11. Johnstone appeared for the respondents, Jack Sanger and Robert Clemow [ Mr. Billing said the case was sn appeal upon points of law v.nder the Justices of the iPeaee Act, against the decision of a Magistrate in a casft under the Sale of Foods and Drugs Act. The decisions were made under section 12 of tibe Act, one being in connection with the sale of milk with added water, and the other for selling milk deficient In solids. Both cases had arisen from the same incident, and the magistrate had dismissed the informationsLegal argument was heard as to whether Clemow, who actually had only carted milk for Sanger, was a, seller or seller's agent in the matter. Clemow bad solii to the Health 'Department's officer a sample of 'his own milk and »l«o, on the inspector's demand, a sample of Sanger's milk, although he was only carrying Sanger's milk to Butler to wlvom it had been sold. Clemow's sample had proved all right, hut Sanger's was deficient, and contained added water. Sanger sold no milk to Clemow. It was contended that the. case might be referred hack to the magistrate to be amended in order to see if Sanger could be convicted of selling adulterated milk to Butler. Fia Honor said it would require very strong argument to induce him )u maGS such an order. Counsel for submitted tuat under the Sale of Foods and Driigs Act when a sample of milk was purchased for analysis (she vendor of the milk was to be immediately notified of the intention to make the analysis and the sample taken was to ke divided and a poriion sent to the analyst and a portion sent to the vendor. In the case in question the sample of the milk which was said to he adulterated, ana which wa? Sanger's milk, had been given to Clemow and Sanger had no opportunity of difcovering if the sample of milk was adulterated. Moreover, he contended also that the time had flawd during which an amended information could be laid against him. His Honor reserved his decision.
