SUPREME COURT.

SATURDAY'S PROCEEDINGS. The quarterly session of the Supreme Court at New Plymouth was continued 'on Saturday, before Mr. Justice Edwards. CLAIM FOR WORK DONE. The claim of the Fama Stonewood Co, (Mr. R. JfeConncll) against the Taranaki Amusements Company (Mr. A. A. Bennett), for payment in respect of work done, was resumed. Jlr. Bennett addressed the Court chiefly regarding the relation of contractors and sub-contractors with the owners of the buildings, and quoted authorities to substantiate his claim that in the case before the court the plaintiffs were suboontraetors of Jtessrs Cliappell and Woolley, who were the main contractors for the erection of the building. JI. Connell said that while the authororitics quoted by Jlr. Ecmictt in support of his defence were, no doubt, good law, he contended that they did not apply to the case in dispute. He elaim«| that, the contract of the plaintiff com L panv was made with the defendant com-, panv, and not with the contractors forthe building. Counsel claimed that the.original quotation given to Grierson and" Atnier of £l7O for certain flooring work to be done at Everybody's Theatre, and accepted by them, represented a contract made. His Honor pointed out that the quote obtained and incorporated in the specifications was secured as a guide to contractors tendering for the work. When

J tin l main contract, was arranged the work included an amount ol' fania flooring for which ,£l7O was allowed, and j that- was the contract for which Messrs j Cliappell and Woollry had entered into. ! After the contract had heen commenced the Kama Company had gone to the architects and a.sked about the and were told that the building was ready and that they could' go 011 with their work. The main contractors knew the Kama Company was doing the work, and stood by and s;uv it executed. The contractors, therefore, could riot, refuse to pay for the work done. Mr. McConnell proceeded to quote authorities in support of the claim on b'dialf of the plaintiff company, and submitted that hjs company were contractors and nol sub-eon Tractors. liis Honor reserved judgment. IN BANKRUPTCY. Applications for the discharge of bankrupts were granted in the eases of 11. A. I.ennon (Mr. Johnstone), J. A. Thompson (Mr. Johnstone), A. M. P. Marris (Mr. Rowley). EiTgar Wright (Mr. K. E. Wilson), and James O'Mailey (Mr. Hutehen). The Court then rose.
