NEW PLYMOUTH SESSIONS. The sittings of the Supreme Court New Plymouth were continued yesterday before his Honor Mr. Justice Honking. DIVORCE. G. C. L. Jensen v. Sarah Jensen (re-! spondent) and Frederick Volker (CO** respondent). The petitioner, for whom Mr. A. 11. Johnstone appeared-, asked fof j.a dissolution of his marriage with thespondent on August 10, 1807. The othefr parties were not represented. _ The petitioner gave evidence as to thecircumstances that had led him to suapect his wife's fidelity and the subset quent events which proved his suspicions to bo correct. He discovered his wife and Volker together in a tent at Mokau, and since then they had lived together at, Mokau as man and wife. Corroborative evidence having 'been given Liy tiniest Tabb Sampson, laborer,, living at Mokau, his Honor granted' a decree nisi, to be made absolute in three months, with costs on the lowest scale against the co-respondent. .. IN BANCO. J. E. 1 Fitzgerald (appellant) l v. Tims. William Hamvright (respondent), Mt.j J. IT. Quilli.'im appeared for the plaintiff, and Mr. Frank E. 'Wilson for the respondent. This was an appeal from a decision of the Stipendiary Magistrate at Tr.glcwood, in connection with the delivery of a motor car. The 'parties, had jmtcrcd into a contract for the delivery of a motor car to the respondent by the appellant, about the end of July or the beginning of August, lt>l<s. The motor car was not delivered during the time mentioned in the contract, and on ■September 0 respondent 'wrote to appellant cancelling the contract. The respondent sued in the Magistrates Court for the return of the deposit and obtained judgment, the Magistrate holding that time was the essence of the' contract. This decision was now appealed against. After hearing argument his Honor reserved judgment. The Court then rose till 11 a.m. today.
