CLAIM FOR £ISOO DAMAGES.
« SEQUEL TO A MOTOR FATALITY. Mnsterton, March 20. A case of interest to the farming community and others was concluded in the Supreme Court this evening. It appears that some months ago a man named IT. R. Miller was riding on a motorcycle on the Carterton road, and as he was passing a motor-car a horse rushed out through an open gate at the residence of Mr. John O'Dowd, and, it is alleged, knocked Miller under the car, causing fatal injuries. Mrs. Constance Miller, widow of the deceased, now •elaimcd£lsoo damages from Mr O'Dowd. For the defence it was alleged that the horse that was said to have knocked Miller down was not in charge of Mr. O'Dowd at the time of the accident, but , in charge of his son. It was further alleged that undue negligence had not been shown, on the part of young O'Dowd. After a lengthy retirement the jury •ailed to agree, and a fresh hearing'was ! ordered. Meanwhile counsel for the de- , i'ence wiil move for a non-suit on certain points raised in the ease.
