Deni&on) w«l» charged under the Enemy Trading A*t» with having, on or about becembe* oth, by executing an indenture of license with the Telefunken Company, tradei with the enemy. Tbe case for the Crown sugAMted that on the execution of the ihaetltltfe by the Amalgamated Company the Telefunken Company would be put in * strong position in regard to tne patent rights of wireless telegraphy through out the Common wealth during the existence ' of the war. - It appeared that the draft of license was prepared a considerable time before the war, but was not' executed before its outbreak. Tfca Crown contended that its execution after the war was trading with tt» enemy. Counsel for defendants claimed that the documents failed to show that any financial or other contract had been entered into with or for the benefit of the enemy within the meaning of tho Act. The onlv thing the Amalgamated Company would get vru a formal document whereto they were entitled fit any time from 1912 onward. The general manager of the Amalgamated' Company gave evidence regarding litigation between the Mareo&i* Telefunken, and Australasian wirilwa companies over patents and securing thq lioense.
