IMPORTANT POINT SETTLED. FIRST TIME IX HISTORY OF EMPIRE. Ey Telegraph.—Press Association. Wellington, Last Night. Tiie Chrisichiireh action, Fafibaini, Wright and Co. v. Levin and Co. Ltd. (Mere-mints' Association), has been settled out of court, defendants paying a. substantial sum in full settlement. The action was tried before the Court of 'Appeal in April, ltlU, t.'. determine whether plaintiffs' statement of claim was good in law. The Full Court unanimously decided that plaintiffs had a good cause of action against defendants on the ground of conspiracy, amountiii'/ to illegal interference with Fairhairii, Wright and Co.'s method of conducting business connection with the purchase of sugar. Defendants obtained lea<>: to appeal to the Privy Council, and have now abandoned the case. Now that no appeal is to be taken to tne Privy Council the law in New Zealand is established as follows:—" That anyone who suffers damage from a combination of injury amounting to a breach of the Commercial Trusts Act has l is remedy in a court of justice for damages to the extent of the loss he can prove." Tliis is the first time in the history of the Knvpire that the above prcpostion has been established ill law.
