NEW PLYMOUTH BOROUGH! COUNCIL. "\TOTICB is hereby given that at' an Special Meeting of the New Plymouth Borough Council held on the lfithy day of April, 1915, it was resolved (by way of Special Order) that tho- New Plymouth Borough Council make ByLaws under "The Municipal Corporations Act, 1908," the object and purpose of which By-Laws are as follows: The By-Laws are made in pursuance of the powers and provisions contained in "The Municipal Corporations Act, 1905," and the amendments thereof and in pursuance of all and every other powers and provisions enabling the Council in that behalf and are divided into XXIV. parts. They provide for the repeal of all By-Laws now in force in the Borough, and for the repeal or amendments of the present ByLaws by Special Order;
PART I. defines the extent and operation of the By-Laws, and in particular divides the Borough into three parts, viz., "Area No. I," "Area No. 2," and "Area No. 1 3," and gives the boundaries of each area; Confirms the appointment of all Inspectors and Officers of theBorough already appointed, and makes provision for the removal and appointment of; all Inspectors and Officers; Makes provision for'the execution of all orders of the Council and service thereof on the 1 necessary parties; . Makes provisions as to application for and' grant of all Licenses issued on behalf of the Council; • Makes provisions as to offences generally-;-Provides that, all licenses shall expire on the'3lst day of March in each year; Gives power- to the Conncil to reduce or increase all fees for licenses and' aH charges made or payable- under the By-Laws. PART 11. gives the meaning of the special words and phrases used throughout the By-Laws. IPART 111. relates to public health, safety and convenience; the protection of the property of the Corporation, and makes provi-, sion relating to the good rule and government of the Borough and in particular provides for the licensing of shooting galleries and weigh-bridges, and the fees payable therefor.
PART IV. regulates the use r of streets, private streets and rights-of-way by persons and vehicles and the licensing of vehicles and drivers and formation of private streets and rights-of-way, and in particular provides what shall be offences by persons improperly using streets, private streets or rightsof way, and fixes fees payable in Tespect of all licenses issued under such parts arid the cancellation of all licenses for improper conduct.
PART V. regulates traffic on streets and thb licensing of traction engines, motor waggons and delivery vans, and the wcigTit and route thereof, and the licensing of drivers thereof, and fixes fees payable therefor respectively and makes special provisions a» to "heavy traffic" and as to width of tyres.
PART VI. regulates vehicles generally and in particular the Licensing thereof and mode of application and fees payable therefor, the licensing and conduct and duties of drivers and conductors and fees payable on issue of license, stands for vehicles and rates and fares for passengers and goods.
PART VII. regulates the use of tramways, and particularly as to conduct of drivers and conductors and passengers.
PART VIII .contains general provisions respecting building sites, foundation, construction, arrangement and repairs of buildings, the mode in which and the materials of which they are to be erected and repaired for securing stability, prevention of Are, public safety, and for purposes of health, and for the erection of buildings of a public character, and fixing building < districts, frontages and open-air spaces and the prevention of overcrowding, the inspection of all buildings during construction, and fixing charges therefor, and as to erection of verandahs and balconies and sign-boards, the erection of hoardings and scaffolding, and of tents. - PART IX. provides for the prevention of fires, storage of "dangerous" and "specially dangerous" goods, fire escapes and generally for public safety from fire.
PART X. makes general provisions respecting the drainage and plumbing of buildings and the appliances and conveniences therewith, the prevention of refuse accumulation, regulating or preventing the keeping of animals and poultry, regulating the use of stables, the prevention and abatement of nuisances, the conservation of public health, safety and conveniences, the inspection of lands, buildings and premises and the licensing of drain-layers and plumbers and fixing fees therefor. PART XII. regulates the use of public buildings, enclosures and grounds and tlio licensing of pubi lie buildings and fees payable therefor. PART XIII. regulates the use of the abattoir and fixes fees for slaughtering thereon, and generally regulates the sale and storage of meat, regulates the conduct of all persons using the '• abattoir and prevention of improper conduct therein, the licensing of butchers, vendors and purveyors of meat and fees payable therefor, regulates the use of butchers' shops and mode of erection, and provides for the proper carrying out of all sanitary and other arrangements in connection with such shops. PART XIV. regulates dairies and milk supply, and the inspection, lighting, ventilation, cleansing, drainage and water supply of dairies and milk shops, and the licensing iof dairies and milk shops and of milk carts, and fixes fees payable therefor. PART XV. regulates the licensing and duties of wiremen and tlie supply of electricity and works connected therewith, and fixes fees for licenses and charges for supply of electricity. PART XVI. regulates water supply and works connected therewith and fixes charges for ordinary and extraordinary water supply, the connection of all buildings with the water supply and what material to be used and ! sizes of pipes and taps, and fixes fees for inspection of all , ( works and testing of taps, cisterns and meters., • PART XVII. regulates the use and control of public libraries, the use of libraries generally by the public, and subscriptions payable thereto, and provides for the maintenance of quietness and good order therein. PART XVIII. regulates the use of public baths and bathing generally and fixes fees for the use of the public baths and provides for the good conduct of all persons frequenting the public baths or bathing on the beach and for mixed bathing and the wearing of proper bathing costumes. IPART XIX. regulates the licensing and control of billiard saloons and fixes fees therefor and the conduct of all persons frequenting the same and the prevention of all gaming and wagering therein. PART XX. provides for the regulating and licensing of boardinghouses and fixes fees payable therefor, and for the proper conduct of such houses and limiting the numbers to bo lodged in a boarding-house and in each rsomthereof, and for the proper separation of the sexes. PART XXI. regulates the licensing and proper conduct of all hawkers and pedlars, and keepers of coffee or other street stalls, and fixes fees for the same. PART XXII. provides for the licensing of porters, criers and bellringers and fixes fees for such license and the charges to be made by such porters, criers and bollringers and for their proper conduct. PART XXIII. regulates the use and and management of the cemetery and fixes the size and charges for the purchase of burial lots and also fees payable in respect of burials and the keeping clean of graves and as to the erection of headstones and monuments and of family vaults. PART XXTV. provides rules of procedure at meetings of the Council.
The said Resolution will be submitted for confirmation to a special meeting of the Council to be'held at the Council Chambers, King Street, New Plymouth, on WEDNESDAY, the 19th day or May, 1915, at 7.30 p.m., at which meeting the day of tlie coming into force of the By-Laws will be fixed. A copy of the proposed Special Order and By-Laws is deposited at the office of the Council in King Street, New (Plymouth, where the same will,lie open for public inspection, during office hours, from the 10th day of May, 1915, until the said confirming meeting is held.
