PUZZLE FOR POLICE.
THE LICKNSiNG A'Jl'. By Telegraph—Press Association. Paimerston N., Yesterday. A judgment of interest to hotel-keep-ers was delivered by the magistrate, Mr. Poynton, to-day. Cliilds, licensee of the Commercial Hotel, was charged with permitting drunkenness, also with selling liquor to an intoxicated person. The son of defendant, who was acting as barman, supplied the liquor and was convicted! Defendant was absent. j The magistrate said that in order to make the licensee liable the sale must be to an intoxicated person, not to a sober companion who shouted for him as in the present case, unless it was clear that the sober man was agent of tit other. The law was clearly set out by a judgment of five Judges. On the second charge of permitting drunkenness the law required knowledge on the part of the licensee, or his servants, that a drunken person was on the premises. The barman swears he did not know the man was drunk until after he was served Both cases were accordingly dismissed.
