TIMES V. DOMINION
THE CASE CONCLUDED. JURY UNABLE TO AGREE. By Telegraph—Press Association. Wellington, Last Night. The hearing of the New Zealand Times v. the Dominion libel action claiming £3OOO for damages, was concluded on Saturday. Mr. Justice Hosking summed up at some length and put the following issues to the jury:— (1) Was the article in question published of and concerning the plaintiff company? (2) Is the article defamatory? (3) Is the article a fair and bona fide comment on the matter previously published by the Times in the newspapers put in evidence? (4) If defamatory, and not fair comment, to what damages is the plaintiff company entitled?, After four hours' retirement, the 'jury intimated that it was unable to agree.
Mr. Skcrrclt, for plaintiffs, intimated that he would state on Monday what course lie would take.
