The Cauntess de Gasquot (nee James) sued Duke Borwin of .MecklenburgSchwerin for restitution of conjugal rights. The Countess is the American widow of a French count, and married the Duke, who is a cousin of the reigning Archduke, at the Dover Registry Office in 1911. A religious ceremony was performed in France two months later, but the High Court of Mecklenburg annulled the marriage, on the ground that the Duke had married without his guardians' consent. The Countess, therefore, is not his wife in Germany, and asked the court to define her position in England.
