SOLICITOR IN TROUBLE.
ALLEGED FI'At'DULENT CONDUCT. By Telegraph—Press Association. Christchurch, Saturday Night. Judgment was delivered by .Mr. Justice Dcnniston in (lie case of the Official Assignee in the estate of Walter Slutw versus the Timaru Property Company and others. The action was to set askic an agreement of sale and purchase between the parties on the ground that it was inequitable and unconsiderable. A lengthy judgment reviewed the facts. Shaw, said the judge, bad been the active party in securing the transaction, and had employed for the purpose fraud and falsehood. It was not merely a question of concealing fact. Shaw deliberately understated the defendant's liability and misstated his own financial position, but the court knew no reason which suspended or modified the doctrine that lie who came for relief from a hard or unconscionable bargain must come with clean hands. Judgment was given for the defendants. Mr. Hunter, for the Law Society, applied for a rule nisi calling on Mr. Shaw to appear before the fourt to show reason why he should not be struck oIT the roll on the grounds of I .fraudulent conduct and sentenced to imprisonment. The judge granted the request. .
