Wellington, -Saturday. TVi Chief. Justice, Sir Robert, Stout,! ga'f iv. gment. to-day in the ease Herbert Stacey Home v. Dalgety and Co., in which certain questions of law had to be argued before the trial of the action begun. The statement of claim set fortli that Home went to the reserve of the engineer employed in looking after the sheep-shearing machinery exhibited by defendants at Blenheim" Agricultural Show and got caught in the machinery. Damages were claimed for the injuries received by the plaintiff. The Chief Justice -held that there was no negligence on the part of the defendant in properly protecting machinery, and that the statement of claim did not disclose a cause of action.
