A GISBORNE CASE. Bj Telegraph.—Press Association. Gisborne, August 21. A civil claim, the evidence, in which finally elicited from the Magistrate, Mr. Barton, the remark that one party or the other should be in gaol, occupied some time to-day. Vivian Edgar Currier, laborer (Mr. Kane), claimed from Michael Doherty, stable proprietor (Mr. T. A. Coleman), £3l 12s 2d as per the following statement: —Half share of profits'on the sale of about 32 head of cattle £ll 10s 3d, grazing lots of cattle enumerated £7 14s lid, deposited for 13 weeks £35 15s cash, deposited £ll 13s Gd, totalling £66 19s Bd, which, minus £35 7s 6d payments made by defendant to plaintiff, was reduced to £3l 12s 2d. \ Plaintiff and defendant alone gave evi-; dence. Counsel did not address tho Court. "This case," summed up His Worship, "is certainly unsatisfactory. Plaintiff on one hand says he was employed by tho defendant as stablemen at £2 2s a week, with an arrangement for 15s a week for board. After a little time he says that defendant proposed that he should go into shares with him. He says that defendant also agreed that they should go halves in the cattle, in consideration of the plaintiff allowing him the use of the paddock which he (plaintiff) got from his father. Defendant absolutely, denies all <)f this. It is impossible for me, in the absence of some outside testimony, to say who is telling the truth. There is wilful and deliberate perjury on one side or the other. It is a long time since a case was before me in which there was so much lying." Mr. Coleman said that his client courted closest investigation, and that all papers connected with the'case could be inspected if necessary.
