SUTTON'S CASE. By Telegraph—Press Association. Gore, Last Night. The court-martial which was commenced on Friday was resumed to-day. Sergeant-Major Instructor Horace Sutton, New Zealand Permanent Staff, a soldier of the New Zealand Defence Forces, was charged with conduct calculated to prejudice good ords? and military discipline, in that he, in the Defence Office at Gore, on Tuesday, July 30, in the hearing of Quarter-Master-Sergeant Graham, when ordered by Captain Glendinning to proceed to Balfour and make that place his headquarters as from August 1, replied, "I refuse to do so," or words to that effect. Captain Hickey, D.5.0., appeared for the prosecution, and Mr. Cochrane was counsel for accused. Captain Hickey was asked to give evidence as to accused's character. Mr. Cochrane objected, stating that the ease for the prosecution had been closed. This was overruled. Witness read a statement detailing the date when accused was sworn in. He had not been previously convicted, and there were no entries on the conduct sheet against him. He was entitled to pay as SergeantMajor to date. Cross-examined, witness said that he did not know anything of Sutton's record in the Imperial Army. The Court subsequently considered its verdict, which will be submitted to headquarters before being made public. Meantime Sutton is still under open arrest.
