THE LOST ELINGAMITE.
THE CASE OF CAPTAIN ATWOOD, By Telegraph—Press Association. Wellington, Last Night. < In accordance with the special Act of Parliament passed last session, Captain Atwood, master of the wrecked Huddart Parker steamer Elingamite, will shortly have the opportunity of appealing against the decision of the marine enquiry given in 1903. The ground of appeal is mainly the fact it has been since proved 'by Admiralty surveys that the position of the Three Kings, on which" the Elingamite struck, is wrongly shown on the chart. As it is impossible £o reopen the inquiry with the original assessors, one of them, Captain Waddilove, having been drowned in the Duco, the Minister of Marine has referred the matter to the Supreme Court for hearing. This was communicated to-day to the registrar, and a fixture will in due course be made. On application by Captain Atwood's counsel, the court will be composed of a judge and two nautical assessors to be appointed by the Minister of i Marine.
