WATERED MILK.
JUDGMENT AGAINST A I | SUPPLIER. By Telegraph—Press Association. Auckland, October 24. The Magistrate's Court was occupied this morning with the case in which Thomas Steele Duncan, farmer, sued John Redfern and partners, dairymen, of Grey Lynn, for £l4, said to be due for milk supplied under a contract. There was n counter-claim for £SO damages, alleged to have been sustained by the defendants in losing custom on account of the poorness Q,f quality of the milk. After hearing addresses of counsel, Mr. Kettle said it was obvious that, where dairy people contracted for a supply of milk, it was absolutely essential that the supply should be of the best quality. From the evidence it was plain that a large quantity of the milk in question was not fit for consumption when it was delivered by the farmer. lie was bound under his contract to deliver the milk of a quality sufficient to pass the Government regulations, but it was clear that the milk would not pass, foi'*on September o .the inspector took a sample from the cans before they reached the dairy, and upon analysis it was shown that 22 per cent, of watsr had been added. In his (Mr. Kettle's) opinion the fact that the water was found on this particular occasion justified the presumption that it had been watered all along, and he thought it likely that the water might have been contaminated; therefore judgment would be in favor of Redfern and 00. The question of damages was held over.
