The Official Assignee in the estate of Edwin Paw son, sawmiller, Dannevirke, a bankrupt, sued Ernest George Ingley, Arthur John Ingley, farmers, Fitzrov, New Plymouth, "William .Jame.s, Pawson, farmer, Ma.ngatora (Dannevirke), and Emma Louisa Pawson, wife of bankrupt, the public trustee, Thomas Shailcr Weston (solicitor. Xew Plymouth), the Registrar-General of Lands, and Frank Grislev McKenzie (farmer, Dannevirke). The Official Assignee moved that the memoranda of transfer of land, stock and chattels be set aside and declared fraudulent and void. It was alleged that Joseph Ingley, a discharged bankrupt, ■father, and agent of defendants, A. J. Ingley and E. G. Ingley, acquired the confidence of Edwin Pawson, and obtained an undue influence over him. Defendants A. .1. Tngle.v and E. G. Ingley also obtained undue influence over Pawson. Pawson applied before going bankrupt to the three Ingleys for advice and assistance. .Joseph and Arthur got Pawson to transfer a farm of 29fi acres, valued at £4700 in IflOS to Arthur Ingley, and in November, IflOfl, to Ernest George Ingley in exchange for six valueless sections at Lower Mutt. On June. 14, 1010, Pawson, who was missing, and has not been seen since, was adjudicated a bankrupt. Evidence was given by "Mr. Gurr, D.0.A., A. L. Wilson, land' valuer, T. 11. G. Lloyd, solicitor, G. Ingley. Joseph Ingley, W. Rutherford (public trustee agent). When the court, resumed this morning, Mr. J. P. Inne.s. counsel for plaintiff, informed the court that a settlement had 'been arranged a.s follows: Ernest George Ingley to pay plaintiff 20s in the £ to all creditors in the E. I'awson estate, all court costs, petitioner's, creditors' and solicitors' costs, etc., within 14 days, otherwise the deeds and transfers of the land and stock to lie declared fraudulent and void.
