WARDEN'S COURT

WEST COAST MINERAL LEASES. By Telegraph—Press Association. Westport, Last Night. In the Warden's Court to-day, Mr. Rawsbn, Warden, delivered judgment in the Mount Radiant mineral case, ia which R. Johnson sought to recover from Ferguson and Gaseoyno, of Napier, possession of the titles to certain mineral leases at Mount Radiant, and also £2500 damages for alleged illegal retention ot some. The Warden (1) refused the prayer of the plaintiff in regard to the assignment and damages, (■>.) decreed •that defendant should hold the leases on trust for the persons advancing money to ipay creditors and all purchasers of shares prior to October 11, and' for Johnson and Purdy; (3) that the agreement of May 13. referring to the sale of one thousand shares to Ferguson, should bo cancelled, and defendants delivered over the. six agreement forms referred to in the judgment, or in the alternative executive an indemnity to plaintiff against any claim that may arise in respect ot any dealings with them on the part of the defendants, amd to account for the proceeds of the sale of any of them, if any were sold. Tt was understood that if ail appeal were not prosecuted further the terms and question of costs would bo settled after the hearing of the parties bv the Warden.
