(From Our Own Correspondent.) At the S.M. Court to-day, before Mr. H. S. Fitzherbort, S.M., Dong (See was charged, on the information of 11. Willis, Factory Inspector, with keeping his shop open after 1 p.m. on Thursday, July 27, and on the same date keeping an employee working after the hour of 1 p.m. Defendant pleaded not guilty. The Inspector gave evidence to the effect that he had seen defendant's employee in the shop and a customer was there with two parcels. The Inspector said the customer had stated that he had purchased the goods earlier in the day, before closing hours, and was then taking delivery. Defendant gave evidence that the goods had been purchased before 1 o'clock. A fine of 10s in the first, and as in the second case, with 7s costs, on each charge were inflicted.

For riding a bicycle on the footpath on Cracroft street, 11. E. Cudby was fined 2s (id and costs 7s.

A Maori named Dick Kopo was fined os and 7s costs for driving a trap through McLean street after sunset without light. Judgment by default was given in the case of Commissioner of Taxes v. Donald H. Rait, claim 5s Od, costs ss. J. Colesby (Messrs Roy and Nicholson) v. J. Coleman (Mr. Stead).—This was a claim for lien alleged to be due on some bullocks. Defendant claimed that all the instalments had been paid, but plaintiff urged, that the last one due had not been paid, the amount being £9 18s lid. He had received no payments since July, 1908, when a payment of £4 (Is Id was made.—Evidence was given by L. B. Grinistone, manager of the Bank of New Zealand, to the effect that a cheque, drawn by J. Coleman, and payable to J. Colesby, had been paid into the * latter's account by plaintiff. The cheque was paid in on August 16. -Some heated exchanges were made between the S.M. and plaintiff's counsel. The S.M. said it was evident to him that the plaintiff was relying entirely on secondary evidence, and that after a date on which plaintiff specified lie had received no further payments he had done so. He would nonsuit plaintiff, and in further cross actions, Coleman v. Oolesby, plaintiff was also non-suited, the S.M. not having sufficient proof that the claims either way had 1 been, discharged. No costs were allowed in either case.

D. George v. H. A. H. Oaridge, claim; £4 6s 3d, balance due on sale of-motor cycle, repairs, and benzine supplied. Defendant paid 5s 3d into Court, and put in a counter-claim, but as no copy had been served on plaintiff it could not be allowed. Defendant disputed several of the amounts and gave evidence that the charge for a magneto plug was 100 per cent, more than others charged, that the handle bars charged for were replaced free by the Adams Company, and that he never gave plaintiff instructions to overhaul the machine. Plaintiff was non-suited for the sum of £1 10s, and judgment was given for £2 Is Od, with costs 20s.
