RECOVERY OF STOLEN GOODS
A PECULIAR POSITION. ACTION AGAINST THE POLICE. 1 By Telegraph.—Prew Association. Dunedin, Last Night. A sequel to the charges against Mrs. Bell and her two daughters, recently before the courts, was heard in the .Mceistrate's Court to-day, when the 1) I.C. sued Detorhve Thomson for the neovcry of goods, valued at £37 10? t.ti, seised by him at. the time of the arrest o* >!r>. Bell, "f the course of argument it wa- stated that the police took no responsibility in the matter of the goods. They did not belong to them, aaJ they • did not care what onier was made. Mr. Bedford, who appeared as "amicus curiae," contended that the real owners of the goods were Evelyn, Francis E„ and Beatrice Bell, and they should have been before the court The real case was between the D.T.C. and these three persons. Any order given , now must necessarily prejudice the Bells, because they were not before the court. Plaintiffs should have taken such procedure as would have brought the proper parties l>efore the court. The '- ipolice should have applied to the court for an order as to what to do with the goods, and then the court would have seen /that all parties interested wore 'brought bpforc it.' The Magistrate (Mr. Widdowson) said he thought the Bplls should be joined. ** He tnonght the proper thing was to remove the caie to the Supreme Court and have it interpleaded. His Worship adjourned the case until next Tuesday, « and toht Mr. Bedford he must take any action he thought fit in the meantime.
