(Mt. kenrick, S.M., June 15.) POLICE CASE. F. L. Cresswe.il was fined 10s and costs (7s) for riding a bicycle on the footpath. JUDGMENT SUMMONS. Richard Davis v. Henry Ilickton, claim £3 ISs <)d; no appearance of judgment debtor; ordered to pay .amount forthwith, in default seven days in New Plymouth prison. DEFENDED CASE. llenry Wills of Tarata (Mr. Spence) sued Farnhani Bros., of Purangi (Mr. Anderson) for £144 10s for alleged breach of warranty on the sale of 31 cows. The defendants sold the cattle through Mr. Newton King to the plaintiff on May 19, 1910, and gave a guarantee in writing to Mr. King that they were in calf, but that they would come in late. Twenty out of the 31 proved not to be in calf. Alfred and Edward Mackie gave expert evidence for Lie plaintiff. The defence was that Wells, when making the purchase, did not rely on the guarantee; but on his own judgment, that the price given, viz., £5 per head, was not the market price at that time for that class of cattle sold under a guarantee, and that, according to plaintiff's own evidence, he milked 24 cows that season, and lind his herd all proved in calf he would liave only milked 30. Then his loss would only have been on six cows and not on 20 as claimed by plaintiff. His Worship said he must take time to consider the evidence, and reserved his decision.
A number of eases set down for hearing had all been settled, and were consequently struck out.
