PROSECUTION UNDER THE GAMING ACT. By Telegraph.—Press Association. Wellington, Wednesday. The Appeal Court to-day is hearing Jackson's appeal against a conviction lor having kept a common gaming house. He is a billiard saloon proprietor, and allowed pool to be played. He also allowed ordinary billiards, for which the loser of the game paid for the table. In billiards no stake was played for, and in pool each contestant put in Od or Is per game, the winner taking the lot and paying for the table. Mr. Earl, of Auckland, is for the appellant, and the Solicitor-General for the police. This ig a test case, and if a conviction is affirmed other billiardroom keepers will be proceeded against. THE LEGAL ARGUMENT. Wellington, Last Night. Continuing his argument this afternoon, the Solicitor-General submitted that the term "chance" was more narrowed in its meaning than the term "uncertainty"; that all games were uncertain, and if uncertainty wag the same as chance, all games would be games 01 chance. . He submitted that "chance" was an element of uncertainty purposelj into a game in order to make the issue depend wholly or partly, not upon human skill, but upon the decree of fate, and this was the element introduced by the use of marbles in pooll He then discussed cases on the subject, and various sections of the Gaming Act! _ "Mr. Earl, in reply, said that marbles m pool were not used to give an advantage to one player over another, but on Jy to g' ve a variety to the game. The Court reserved its decision. The Court will sit again on the 24th April, after the Easter vacation.
