APPEAL COURT

NEW TRIAL ORDERED. By Telegraph.—Press Association. Wellington, April 10. Tn the Appeal Court the case of Rex v. Howard, alias Sheppard, was heard. Prisoner was charged with having stolen a sheep-dog, and on a second count with having received it knowing it had been dishonestly obtained. The jury found that there was not sufficient evidence to prove that accused stole the dog, and on the second count that prisoner detained the dog knowing it had been stolen. The court held that the verdict was ambiguous and inconclusive, not showing where the guilty knowledge arose, and ordered a new trial upon the second count at next Palmerston North sittings.
