A CASE FOR THE HIGHER COURT. By Cable—Press Association—Copyright. Received 9, 9.20 p.m. Sydney, March 9. At Leichardt, a publican was fined £3O for selling liquor without a license. The case is important, arising out of the last local option poll, and the principle affects altogether 183 licenses. Under the 1008 local option poll Leichardt voted for reduction, and the defendant's hotel was ordered to be closed. At the 1910 poll, Leichardt favored the continuance of existing licenses. The magistrate decided that the term "existing license" applied to the defendant's hotel, as it had been ordered to close at a givfcn period. It is intended to take a test case in the higher court to fight out the question of whether closing hotels applies where electorates voted reduction at one poll and continuance at a subsequent poll.
