The High Court, upsetting the judgment of the Queensland Supreme and Full Courts, upheld the applications of Byrne, one of the next of kin under the will of Father Byrne, parish priest of Dalby, who bequeathed the residue of his estate over £30,000 to the Archbishop of Brisbane, for religious purposes. The Court by a majority held that the trusts mentioned under the will were too indefinite. The finding means that the property goes to tlie relatives.
