A SUCCESSFUL APPEAL.
Hv Teiegra ph.—Press Association. Wellington, Friday. Mr. Justice Cooper gave judgment today in the ease Gordon v. Buttrey, an appeal from the decision of Mr. W. R. Haselden while sitting at Masterton as District Court Judge in March, 190.1. Buttrey sought £2OO damages from Gordon for alleged wrongful arrest respecting a debt of £5 0s 7d, and the jury awarded him £SO. The appeal /was .on points of law. To-day the Court held that there was no evidence to go to the jury that applicant (Goddon) by any misconduct on his part obtained the' warrant for Buttrey's address, and therefore the ease should not have been left to the jury, as there was no material to be submitted to them upon which thev could find a verdict for respondent. The appeal was allowed, and the judgment of the District Court I set aside.
