AN INTERESTING DECISION. By Telegraph.—Press Association. Wellington, Yesterday. An important point cropped up in the Supreme Court to-day in the appeal against the decision of Mr. A. D. Thomson, S.M., who had dismissed a charge against Charles Crabbe of having fished in the Otaki river without a license, contrary to regulation 13. His Honor, Mr. Justice Cooper, dismissed the appeal, holding, as the magistrate had held, that the regulation was ultra vires. The regulation, said His Honor, applied to all salt water fish in New Zealand, whereas it was only intended to protect perch and trout. It was therefore contrary to statute, and ultra vires, j
PIRANI v, PIRANI. Wellington, Yesterday. Judges Cooper and Chapman gave judgment to-day on a preliminary point raised in the appeal of F. Pirani against the judgment of Mr. Haselden on a claim for maintenance made by Mrs. Pirani. The issue toefore the Court was whether a valid agreement for payment had been established. The Court was unable to adduce from the correspondence sufficient agreement to pay £2 15s per week so long as the parties lived apart, and therefore proposed to take further evidence. Judge Cooper suggested that a settlement would be desirable in the interests of th children. Counsel for Mr. Pirani stated that his client had always agreed to make an allowance, but ohjected to a binding agreement. The ease was adjourned until Friday. A HARBOR LOAN. Wairoa, Saturday. The success of the harbor loan poll is assured. There is one small xeturn to come, and that cannot affect the result.
