VARAWA JUDGMENT VOIDED
RESULT OF APPEAL TO PULL COURT. By Cable —Press Association —Copyright. Melbourne, October 5. The judgment in the case Varawa v'. Howard Smith Company, in which the plaintiff was awarded £3OOO damages and costs, has been set aside by the Full Court.
The above case, in which Peter Fedorovitch Varawa, a Russian subject, claimed damages for false imprisonment at iSydnev in .Januarv, 1005, from the Howard Smith Compaiv, was heard before ■Mr. Justice A'B ' kett and a jury of twelve, in the First Civil Court at Melbourne in May last. On .January 21, 1005, following negotiations for the sale of the steamer Peregrine (which it was believed was wanted for Russia, then at war with Japan), the defendant company instituted proceedings against Varawa for breach of agreement, and he was arrested when leaving New South Wales, and held in Darlinghurst Gaol on a writ of capias for eleven davs till security for £4OOO was forthcoming. The judge decided that the defendant's action had been unjustifiable, and the jury awarded £SOOO damages.
