COURT OF APPEAL.
A PATENT CASE. By Telegraph.—Press Association. Wellington, Wednesday. The Court of-Appeal to-day delivered judgment in the patent case Warde and others v. Bardley and Hardley, Ltd. The appeal was from a judgment of Justice Edwards delivered in Auckland on February 23 in an action for infringement of appellant's patent. His Honour **ld there had been no infringement, and this finding was upheld by the Court of Appeal. The question, before detennin ' ation in the Supreme Court, had by the Court's orders been referred to ex- | pert arbitrators, and both the Supreme Court and the Court of Appeal affirmed , their findings, holding, that it must be shown that such findings were wrong. An appeal was wrong before such finding could he renewed. The appeal was dismissed with costs upon the middle Bcale as from a distance. On Mr. Skp rett's application leave was given to appeal to the Privy Council upon security i being given within three months.
