DIVORCE.
A HAWERA CASE.
In the Supreme Court yesterday hisi Honor Mr. Justice Chapman heard a| case in which Eleanor Rodger petitioned for a dissolution of her marriage with Hugh Rodger, tailor, of Hanvera, on the ground of adultery. Mr. Quilliam (instructed by Mr. Sellars, for Mr. Halliwell) appeared for petitioner, and Mr. Welch for respondent, who did not oppose tho suit. In her evidence the petitioner stated that she was married to respondent at Auckland on loth November, 1807. They had lived at Hawera since the marriage. For the first few years they lived happily together, but about six years ago witness discovered evidence of her husband's infidelity, and he confessed. About two years ago she had suspicions of his further infidelity, and she found more evidence. At that time she was very ill, and the doctor 'ordered her away. While she was away her husband wrote to her saying that they nad better live apart. She stayed away for two years, earning her own living, and then "she returned to Hawera to see if hoi- husband was all right. She found he had not reformed, and she then took these proceedings. Corroborative evidence of respondent's adultery with two females was given. Combined with the petition was a peti- | tion for custody of the children and for An agreement on these points, giving petitioner the custody of the children on certain conditions was approved by his- Honor, who granted a decree nisi, to be made absolute after three months, and made an interim order for custody of the children and alimony in terms of the agreement, the order to be renewed when the decree absolute is obtained.
