AIR. WITHEFORD'S CLAIM FOR £49,500. sty felegraph—Press Association. Wellington, Tuesday. The action brought bv James Howard Witheford, formerly M.H.R.. of Auckland, against tho Public Trustee as executor of the will of the late Sir Alfred .1. Cadman. Daniel Berry, of New Plymouth, Allan Maguire and Hamilton Gilmer, of Wellington, in respect to an alleged breach of agreement in connection with the floating of a company to work the Parapara ironfleld at Nelson, caine > before the Chief Justice in Chambers this morning. The case has been pending for a considerable time, plaintiff now bonig a resident of England. The claim is for £49,500 for alleged broach of agreement. The defence is a general denial of the agreement stated by plaintiff. , The particulars of the case as set out in tho statement of claim appeared the other day. The claim was now amend' cd, and counsel said time would be needed'to consider the alterations. _ After argument the further hea ™§ f tho summons was postponed to ft day $0 be subsequently fixed.
