POWELKA.
NOT GUILTY OF HIGHWAY ROBBERY.

Powelka was re-tried at the Supreme Court to-day, before Justice Cooper on a charge of robbery under arms at Kendall's. At the last trial the jury failed to agree. Powelka, from the dock, said he left Wellington on the night he escaped, and reached Porirna next day, Thursday, March 24. He boarded the night train to Palmerston at Paekakariki, and reached Longburn in a cattle truck; then worked his way round the river bed to Stony Creek, and was camped on the river bank. He was never near Kendall's.
The jury viewed the scene of the robbery and, after a retirement of tour hours, returned a verdict of not gnuty, adding a rider that they had no doubt that the Kendalls were held up, but that their identification was not sufficient.
Sentence on all the charges proved against him, and to which he pleaded guilty, will be passed on Wednesday morning.
