Subsequently plarntill was allowed to resume duty till June 29, when tiic Hoard, sifter consultation with a new school comtaittec, wrote him purporting to terminate bis engagement as from September 30. Plaintiff claimed tliat such action was ultra vires, as no charges were formulated against him and he -was not allowed a defence, and that the Board had not properly consulted the school com- | mittec.
