AN ACTION DISMISSED. By Teiegraph—Press Association. Wellington, Saturday. An interim injunction granted on September 24 to Christopher Joseph Lyne, school teacher, by Judge Chapman, restraining the Wellington Education Board from removing him from his position at the Lower Hutt District High School and from withholding his salary, was dissolved by Judgo Chapman, who gave his reserved judgment in the Supreme Court to-day. According to his statement Lyne absented himself from duty for a day and a-half owing to illness. Suspension by the school committee followed and was confirmed by the Education Board. Subsequently plarntill was allowed to resume duty till June 29, when tiic Hoard, sifter consultation with a new school comtaittec, wrote him purporting to terminate bis engagement as from September 30. Plaintiff claimed tliat such action was ultra vires, as no charges were formulated against him and he -was not allowed a defence, and that the Board had not properly consulted the school com- | mittec.

The Court to-day held that the conference was properly constituted and carried out and that there 'was nothing to show that the new committee was asked to take evidence.
