The Commissioner of Taxes sued James (lower Clia inters in the Mag.strate's Court for .C2O, being the incometax on 1 a sum of CAtt made by defendant as the New Zealand representative of certain British traders. The defendant contended that neither directly nor indirectly had he sold goods on which the tax was sought to bo leviel, nor did he hold any money for the firms concerned, nor hold power of attorney or authority to pay money on their hehalf. The Magistrate held the defendant liable, and gave, judgment for the amount claimed with four guineas costs.
