Wellington, October 14. uic Appeal Court gave judgment today in the case of the Commissioner of Taxes v. the Nightcaps Coal Companv, heard at .th e last sittings. The company claimed that the annual value of Imsiness premises, to the extent of .£78,1, should be deducted hi assessing, but the magistrate who heard the ob jection excluded the railway dwellinghouse and fencing. The appeal from the magistrate's decision was alloweu with costs.
