PRIVY COUNCIL CASE

By Tclegrnpn.—Press Association. Christchurch, Last Night. A private cable message was received by Mr. W. 11. Wynn-Williams yesterday to the effect that the appeal by the Government to the Privy Council in the dispute between the Stamp Department and Mrs. Townend, relating to the payment of duties in connection with the j estate of the late' G. H. Moore, has been dismissed. The question at issue was whether or not certain transfers of property made by Mr. Moore in his lifetime to his daughter, Mrs. Townend, were subject to deed of gift duty. The late Mr. Moore had during his lifetime handtd over to Mrs. Townend certain moneys and had transferred to her certain mortgages. The Government sought to impose deed of gift duty, but it was contended that the transactions were such as not to be subject to that duty. The matter was argued before the Court of Appeal in Wellington, and a majority of the Judges, Mr. Justice Chapman dissenting, held that the transactions wore, nor linl-la *,o uica of gift duty.
