APPELATE COURT'S JUDGMENTS.

Abbott," the judges appointed by the Racing Conference, have had two appeals before them. They have remitted the Cunningham case to the Auckland Metropolitan Club for the consideration of fresh evidence, which had not been produced at the previous hearings by them. In the Koyal Soult case the judges' decision is as follows:—"In the matter Of an appeal by Samuel George Linds'ay, owner of the' horee Royal Soult, and r Mark Ryah, jockey, against the decision of the Auckland Metropolitan Committee in endorsing the disqualification im posed by the Avondale J.C., the judges are of the opinion that the horse Royal Soult was, wHh the knowledge and consent of the owner, Samuel Geo. Lind-

say, fraudulently prevented from wh- #" ning the Nihotapu Handicap, run on the second day of the Avondale J.C. spring meeting, 1908. The evidence is aot decisive as to whether he was so prevented by an overfcci administered by one Wm. Jones, as alleged by him, or by .being deliberateily pulled'by the jockiy Mark Ryan, though many circumstances' seem to indicate that the confession of Wm. Jones was conclusive

as between himself and Samuel Geo,

Lindsay. The judges feel compelled to give Mark Ryan the benetit of their doubt as to the method adopted in stopping the horse. They therefore cojfirni the endorsement by the Auckland Metropolitan Committee of the disqualifications by the Avondale J.C. of Samuel Geo. Lindsay and the horse Royal Soult for two years, but reverse the decision of the said clubs as regards the disqualification of the jockey Mark Ryan. They call the attention of the Auckland Metropolitan Committee to the evidence given in this case by' Wm. Jones and recommend that h e be disqualified for life. They order the deposits of appellants to be refunded."
