Wilkes tor judgment creditor, and Mr. Hutchcu for defendant.—The defendant, examined, said he was a laborer, married, with three children, working on the railways at 8s 4d a day, less 12» a month for superannuation. About twelve months ago he borrowed £7U oil his life insurance policy to pay certain debts and instalments on a house owned by his wife, since lost. His rent was 8s a week. There was nothing left out of his earnings after keeping tile house going. Without calling upon defendant's solicitor, the .Magistrate said lie could not make an order. THE VALUE OJ? KEEl'lNli UECEII'TS A. S. Uascll (for whom .Mr. Urey appeared) sued Alfred Drake for IDs, the price of a horse-cover supplied. Defendant set up the defence that .Mrs. Drake had paid for the cover. It was clearly lixed in his memory that his wife Jell the trap with a pound-note lie liad given her to pay for the rug. When she returned she said that as there was not a shilling change, the mall in the shop had given her two shillings back. This the defendant's employee denied. The. plaintill', iu evidence, said the. defendant had told him that the receipt Was oil green paper, to which he replied that he had never issued receipts on anything but white paper. Owing to the inability of the defendant to produce the receipt as evidence of payment, judgment went for plaintiff for the amount claimed anil <is costs. Judgment by default was entered in the case Xewton King (Mr. Grey) v. J. 'II. Taylor, claim l£s 3s ltd, and costs lis Cd.
