Mr Justice Hood reviewing the decision of the Justices in tha case in which two men cliarged with assault on a music teacher were discharged on the plea of the '-unwritten law." The defendants were father and brother respectively to a girl pupil of the musician and they resented his conduct towards the girl. •Fudge Hood said the assault by the father of the girl was proved, and no legal defence was made. Some pernicious nonsense was talked'" with reference to what was called the "unwritten law" in America. The Magistrate had dismissed the case on this ground, but it would take very cogent evidence to satisfy him that any British Court of Justice ever gave effect to such a monstrous proposition. Judge Hood set aside tiie .Justice'* decision and lined the elder defendant 40s.
