James Alexander, of W'.inganui, who died about sixteen y w us ago, by his will conferred on his son, William Alexander, pow-r 01 appointment over one-fourth of his residuary estate, valued at a-boui ;no,uuu, on uni determination of the life interest of Mary Alexander (his wife) and William Alexander. Mary Alexander died tflreo mouths ago, and William Alexander died in 1807. lie left all his real and personal property to Alexander Alexander, who is his cousin. The Court is now asked to decide whuthcr the will of William Alexander is a valid exercise of power of the said appointment, and whether Alexander Alexander is entitled to the one-fourth of the residuary estate of the said James Alexander. JnHice Chapman said that owing to the large sum involved and the uncertainty of the working of the will, the matter was, most important. He asked whether it should not be taken direct to the Court of Appeal. ' Judgment was reserved. Five counsel were engaged.
