A peculiar point cropped up ill Eitham Magistrate's Court yesterday wbeu J,t.\iis Alorrell Was charged that m making an application for work in the Ra.lway Department, he did use tlie name and birth eertilicale of an elder brother and forge a School cei'tilicafe. During tlie hearing of the evidence it was staled by the master of the Eltlmni school tnat tne. boy had readied Hi vears o. age last July, since the offence 'had bo.-u committed. The police had been tiding", on the assumption that he was 111 years old and counsel (Mr. Ci. P. Wake) had taken the cast at snort notice and had not had time to inquire as to whether the hid should come under the Juvenile Offenders' Act. Scrgt. Haddrell, for the police, pointed out that the lad had not come before the Court" till he was over 10 and he left it to tie Magistrate to say whether the ag:> limit in the Juvenile Offenders' Act referred to the time at which the olience was committed or the time of the trial, Tlie Magistrate (Mr. A. Tnrnbull) said that, if the boy were a juvenile oll'ender, the mischief was already done owing to the case having been heard in open Court. He adjourned the hearing to allow counsel to look up the authorities in support of his contention that the lad was a juvenile oll'ender, When the Court resumed, Air. T'urnbnll said the Juvenile Oll'cmbrs' Act did not extend his power under the Summary Jurisdiction Act, and' as a magistrate could not try forgery he could not treat accused as a juvenile oll'ender. Accused pleaded guilty and was committed to the Supreme 'Court for scntcucv.
