H'is Honor, in summing up, pointed out that the main issue before the jury was whether the defendant made the purchase of the property in question as the agent for the plaintiff or whether he had made the purchase on his own account. His 'Honor remarked that the fact of a man purchasing land one day and selling it at a prolit of 30 or 40 pel' cent, the following day was not so unusual an occurrence that, it could create any surprise in the minds ot anyone. His Honor -put only one issue to the jury: Did the defendant, when he purchased the property in question from the several vendors, make the purchase on his own account or as agent for the plaintiff? The jury answered that the defendant acted as agent only.
