Till' hearing of Hie case oi .lohn ijulJjcigh v. ilium Thomas Strand, which lull] l)Oou commenced last Thursday, was concluded this evening at the Supreme Court, Xlio plaintiff is a settlor at the Lower Ilutt, and tho delendant a timber merchant earning on business in tho same district. Plaintiff's chum was for C22IU, which, bo alleged, had been wrongfully obtained from jiim by the defendant. The evidence had Ueen closed oil the previous day. Counsel proceeded to address the jury. H'is Honor, in summing up, pointed out that the main issue before the jury was whether the defendant made the purchase of the property in question as the agent for the plaintiff or whether he had made the purchase on his own account. His 'Honor remarked that the fact of a man purchasing land one day and selling it at a prolit of 30 or 40 pel' cent, the following day was not so unusual an occurrence that, it could create any surprise in the minds ot anyone. His Honor -put only one issue to the jury: Did the defendant, when he purchased the property in question from the several vendors, make the purchase on his own account or as agent for the plaintiff? The jury answered that the defendant acted as agent only.
