Muldrock is now proceeding. The ease arises out of a power of attoriiev given hv plnintiir to defendant when lie'left for' South Africa in 11)01). Muldroek managed defendant's farm at Waverley, two sections of which are native
land and still held under restrictions. The property was leased by Hutchison to Hazelhurst when the former left the Dominion. Hazclhurst gave up the lease, assigned it to Muldrock who "uas held t'iio property since. The main point at issue, is whether or not Muldrock is still plaintiff's trustee or was ho releasenl from that position by a document given him in South Africa. Plaintiff asks defendant to be declared a trtlstee.
