Sergeant Bowdeu, of the police force, stated in Court here this morning that there had not been a local female resident convicted for drunkenness here for two years, and no local male, resident for six months. Occasional offenders who came before the Court were strangers to the district. DEFECT IN LICENSING BILL. Wellington, Last Night. The information against Herman Sigurd Pearson, fruiterer, of Wellington, who last week was convicted and fined for selling whisky without a license, was dismissed by Air. Riddel!, S.M. .today, in his reserved judgment, on a charge of unlawfully keeping liquor for sale. At the hearing of the charge, Mr Wilford had submitted on behalf of the defendant that there was no offence under the Licensing Act of 1881. Section lot) of that Act, said his "Worship, made the selling or exposing of any liquor which the defendant was not licensed to sell, an offence, and provided a penally for each act, but the section did nht refer to keeping for sale as au offence' in .any way. Section 18(1 empowered any inspector of police to issue a search warrant for the detection" and seizure of liquors kept for sale contrary to* law, and again in section 187, provided that in the event of the owner or occupier of any premises being convicted ot exposing for sale any liquor which he was not authorised to sell, tin; liquor so seized should be forfeited. This section seemed to imply that kccpiiminiuor for sale by an unlicensed person v-aji an offence, but in no part if the Act was such a fact actually stated. It was clear that the defendant kept liquor for sale without a license, bit as the Act, in the opinion of his Worship, did not make this an offence he coud not be convicted.
