Per Press Association. Wellington, Last Night. His Honor Mr. Justice Button and a special jury to-day beard the case in which Richard Elliott, a baker, sued the City Council for £SOO for injuries received, in a tram accident on the Brooklyn line last May. The Council had paid £OS into the Court in satisfaction of plaintiff's claim. The Council contended

that plaintiff was exaggerating his injuries. The jury awarded £250. A new trial is to be moved for, on the ground that the damages given by the jury are excessive.
