It appeared that the land, on which the. house stood was purchased for plaintiff by an agent in whose name the insurance was effected. The transfer of the land to plaintiff was duly effected, but that of the insurance policy was not, and the company refused to aeknow)edge. plaintiff. The defence was thai there was no contract with plaintiff, and that there were no material misrepresentations in the proposals which would void the policy, and tlmt misrepresentations were made in such a way as to amount to a warrantv. Mr. .Justice Williams nonsuited plaintiff, but said he and his agent had acted in perfect good faith. I
