A BETTING CLAIM.
Per Press Association. Dunedin, Friday. A hotting case occupied the attention of Mr. Wiiiilmvson, S.M., to-day. Arthur Ceddes sued Lewis Curtis for £B2 14s, the amount of a dishonored promissory note and cheque given in payment of money won by war ring over the Christchureh races. Defendant alleged that the stoppage of payment was by authority of ■ plaintiff's grandfather. Under cross-examination, defendant said he had previously won money from plaintiff and been paid. He denied having any partnership with Ben Geddes, plaintiff's father, whose clerk he was. Mr. Mac Donald, defendant's solicitor, submitted that the money was irrecoverable at law, as it was clearly given for gambling purposes. Mr. Burnside characterised this plea as contemptible. Defendant had taken plaintiff's money at different times, and as soon as he lost he declined to pay up. However, he must accept a nonsuit. He submitted ■that, as defendant was both alleging his own wrong and committing a breach of the morals both of the turf and" of the world, no costs ought to be allowed. A nonsuit was entered without costs.
