AN ORDER REFUSED.

Per Press Association. Dunedin, April 20. This morning Mr. Widdowsou, S.M., gave judgment in the case of the Dunedin City Corporation v. Napier. Complainants applied to have a stable in Hope street pulled down as being insanitary. A certificate of the Health Ollicer had been given, certifying the building to be dangerous to the public health. Mr. Widdowson finds that the stable, though old, and perhaps not up-to-date as the authorities require, seems to be in a remarkably good state of preservation, and in fairly good order and condition. lie is of opiniou that it was not paved to be decayed or dilapidated, and tiiut lie would not be justilicd in making a.u order to pull it down. Judgment was given fur defendant with costs (.€<> Us), each party to pay their own expenses.
