Wellington, February . The jury, after a retirement of half-an hour in the divorce suit, William Pacey y. Thomasina Pacey and E. V». Dorset, found that respondent had committed adultery with Dorset prior to her departure from Levin, but that Pacey condoned this. They further found that there had been subsequent acts of adultery between respondent and corespondent, and that three separate allegations of adultery made against petitioner were false. They therefore found for petitioner and awarded hiin £IOO damages against co-respondent. His Honor then granted a decree nisi, to be made absolute in three months.

His Honor, in giving judgment on an application to make co respondent liable for tbe wife's costs, said lie thought the husband should pay these in accordance with the usual practise. Jle had brought an extortionate claim for £15,00, and had been awarded only £IOO, so it could not be said there were special circumstances to justify any departure from the general cours( followed. Hi? Honor ruled that petition pay '£4o as respondent's costs, and that the co-respondent pay £IOO damages and £45 costs of petitioner and also repay to petitioner the £lO « penses allowed to respondent. Go-rc-spondent also to pay disbursements. costs of Conrt, witnesses, etc.
