Proceeding for as penalty against 24 slaughtermen and assistants at Pareora freezing works, under Seotion 16 of the amending Act of 1908, for breach of award, was heard this afternoon before the Arbitration Court (Judge Sim presiding). Evidence was given showing that the works were idle on Friday Saturday and Monday through the de-' tcndauU ceasing work. i Mr -, S " p.-tiaynioud, for defendants, submitted that as tlio award was made m June, 1905, and the Act (first makmg it an offence to strike) did not come into opt ration till tho end of October that year k Act did not apply to this award. His second contention was that the Court's jurisdiction to make an award is limited to cases in which there is an existing industrial dispute, and in this ease there was no dispute, the parties having arrived at a mutual agreement.

Mr J. White, Crown Jt'rosecutor, in reply, said these arguments were more ingenious than sound, and if allowed it would be impossible to get a con Tic.' tion on any award made before the Act of 1905. The Judge announced that tho decision would be given in the morning.

SOUTHLAND SLAUGHTERMEN STRIKE.

They ask for 25s a hundred, the usual batch of holidays to bo paid for at double tunc, and 2s an hour for waiting time over an hour. As there is no slaughtermen's union in Southland, the Arbitration Couit cannot touch the matter.
